The labour justice in Costa Rica

Abstract

It is up to us today, within the general framework of the symposium on "The Costa Rican judicial model", to address the issue of labour justice in Costa Rica, from a critical perspective. The limitations of the time granted to make the exposure and the variety and breadth of proceedings in this area, (ordinary major judgment, small ordinary judgment, collective social economic conflicts, occupational risks, faults and contraventions of labour laws), proceedings before the Civil Service Tribunal, prevent us from conducting a thorough analysis of all of them; this considering only labour justice before state courts, since, increasingly, labour law offers us an important range of judicial activity in joint bodies established by collective convention or other collective instruments that perform important functions, such as those developed by well-known institutions in our midst under the name of Boards of Labour Relations , bindingly, in some cases, or as a recommendation in others, establish a number of guidelines for industrial relations, however, we will at least try to identify the main issues that may be affecting better justice in the workplace.
If we are going to make a critical analysis of a particular system, in this case the labour justice system, we must take benchmarks for the approach and they are certainly in this case the speed of procedures and excellence. In other words, we must verify, in this study, what may cause justice not to be prompt or whatever is at risk of its quality. Although in the background it is basically a single element, quality, because haste is but a component of it.
