Abstract
Article 79 of the Constitution stipulates that "Freedom of education is guaranteed. However, any private educational centre shall be subject to state inspection."
In the definition of the Freedom of Education, as in the case of other legal institutions, one can speak of two stages: before the Constitutional Chamber and after the Constitutional Chamber.
In fact, before the Constitutional Chamber, the Political Constitution did not have a power and fullness acceptable power. The content of the Freedom of Education required a claim, as its scope was not effectively protected. It was necessary to resort to certain antecedents and doctrine. Then we pointed out that:
"... the Constitution, in a particular and prominent way, guarantees freedom of education (article 79) 'with the sole circumstance, but not condition, of being authorized, also constitutionally, the State inspection in relation to any private educational establishment'. This was stated by the Attorney General of the Republic, Otto Rojas Vargas, according to opinion #25-0-10 of September 30, 1961."
