Abstract

   The issue of natural rights, of traditional cut, is now presented in new form, under the heading of human rights. What is the reason for this new presentation? Does this new way of presenting a change in content on the old issue? These reflections are directed to answer these questions. In them will follow closely, in its first part, the thought of St. Thomas of Aquinas on the particular according to the study of Jesús García López.


Assuming that the rights, in their own sense, are deprived of people (things, whether animal or inanimate, have no rights properly speaking), and that the only people in question are human rights, it is already understood that, when talking about natural rights, the reference is to the rights that are based on the very nature of human beings. However, within modern and contemporary thought, both legal and philosophical, it has been intended to impose a conception of man according to which one must not and cannot speak of a human nature, for the reasons which will then be seen. It therefore seems appropriate to speak better of human rights, without prejudice to explaining the error made by those who seek to deny human nature.
