Reflections on the principle of typicity in societies mercantile

Abstract

In a recent article ', we examined the limits to private autonomy set by the so-called "prohibitive imperative norms", that is, those norms by means of which the legislator, expressly -and jurisprudence in an interpretative way- sanctions the illegality of a declaration of private will made by a subject of law. The function of these kinds of imperative norms is, as we said there, the need for the right to prevent elfoedus iniquum.
