Abstract

It is not until the Penal Code of 1971 that in Costa Rica these crimes are conceived autonomously, through specific regulations. Historically, there has been a great terminological confusion in the doctrine on these crimes, as they are both very similar, however, in the 1971 Penal Code a basic differentiation was given that delimits with great precision the scope of these two typical figures.
