Sovereignty, rights, intellectual property and environment

Abstract

This article aims to address the implications of intellectual property rights, especially those applicable to living matter, on national sovereignty and the environment. To do this, we analyze what are the main arguments and points of contact between the two themes.
1. The Convention on Biological Diversity (CBD) has reaffirmed the sovereign rights of countries over their natural resources, sovereignty which had a strong roots and acceptance in international law. At the same time, it establishes as one of its objectives the fair and equitable distribution of benefits resulting from the use of genetic and biochemical resources. None of these aspects are considered by the Intellectual Property System. In this order of ideas, there has been no lack of anyone who sees a conflict between the intellectual property system (especially because of its extensions to living matter) and the CBD.
