The legal situation of the inhabitant against public spending situations arising from substantial expenditure legislation and budgetary legislation

Abstract

Before entering into the development of the underlying theme of this article, I refer to some definitions that I consider necessary:

The inhabitant: For the purposes of this work, the concept of inhabitant is adopted since in real terms this concept responds to better guardianship interests that are intended to be addressed. The concept of inhabitant is much more comprehensive than that of citizen, for example, in that it does not refer to the age of majority, political or taxpayer status, but simply to that person who lives temporarily or permanently in the national territory.
In a similar sense, Professor Jesús González Pérez substitutes the concept of citizen for that of Managed in order to give content to "the humanistic demand induced by the premise of the dignity of the person as a constitutional premise."

The Budget: In the exposed context that the Political Constitution is the postulate of the terms in which the group is willing to live together. The Budget Law or expenditure authorization is the programmatic law and the regulatory mechanism that allows the public function to direct the content of rights and declarations of principles of the Political Constitution.
The Budget as a means: The importance of planning and clear definition of goals as a task prior to the preparation and approval of the Budget, is necessary, in the meantime, as defined by some Spanish doctrine, the Budget Law is a law "instrumental" that allows the legal development of the voluntarist content of the Political Constitution.

Purpose of the budget: The purpose of the budget is to plan the activities aimed at obtaining the satisfaction of public needs, activities to which budget content and spending authorization are granted, assigning resources obtained through public revenues.
